MW represents Themis Capital and Des Moines Investments Ltd. in connection with litigation against the Democratic Republic of Congo. MW was retained to conduct complex domestic and international discovery directed at enforcing the clients’ judgment of approximately $70 million.

Eleventh Circuit Affirms Florida District Court Summary Judgment Award

MW obtained a unanimous affirmance by the Eleventh Circuit of a summary judgment award by the Southern District of Florida dismissing an action for misrepresentation and breach of duty in the sale of bank securities against the Bank’s former CEO.

MW Defeats Motion to Dismiss in the Southern District of New York on Behalf of MasterCard

MW represented MasterCard in an action against two former executives in its information security department and NIKE alleging employee raiding and theft of confidential information. MasterCard claimed that the two executives, who resigned to join NIKE, breached agreements not to solicit MasterCard’s employees and suppliers, among other things. MasterCard also alleged that NIKE tortiously interfered with the executives’ non-solicitation agreements.

MW Wins Summary Judgment in the Southern District of New York on Behalf of Dutch Nationals in an Action against Zimbabwean Entities

MW represents a group of Dutch farm owners whose land was expropriated by the Republic of Zimbabwe (“Zimbabwe”).  After Zimbabwe refused to pay a $25 million judgment (“Judgment”) against it, Plaintiffs brought a declaratory action seeking to enforce the Judgment against five Zimbabwean entities on the grounds that they are alter egos of Zimbabwe.

MW Successfully Obtains Spoliation Sanctions and Attorneys’ Fees for Ocwen Loan Servicing, LLC

MW represents Ocwen Loan Servicing, LLC (“Ocwen”) in an action to recover nearly $5 million in mistaken overpayments from defendant Ohio Public Employees Retirement System (“OPERS”).  Ocwen was the calculating agent for an asset-backed security trust of which OPERS was a certificateholder.

MW acted as lead counsel for seven former officers and directors of a failed Florida bank during an investigation by the Federal Deposit Insurance Corporation, as receiver for the bank.

MW represented the former CEO of a failed Florida bank in an action brought against him by shareholders which invested $10 million in the bank. In 2012, the Court granted MW’s summary judgment motion dismissing the plaintiff’s claims against the CEO for negligent misrepresentation and breach of duty.

MW represented several Triaxx entities ("Triaxx") in opposing an application by The Bank of New York Mellon, as Trustee for various securitizations, to approve a settlement over the objections of numerous certificateholders. Triaxx argued that the Trustee improperly released over $31 billion in modified loan repurchase claims for free without first investigating or valuing the claims.
